These Terms of Use (“Terms”) govern your use of the ChatterBudz applications (ChatterBudz Chat, ChatterBudz Pay, and ChatterBudz Play) and related services (collectively, the “Services”), operated by Territory Cybernetics Pty Ltd (“we”, “our”, “us”). By accessing or using any ChatterBudz application, you agree to be bound by these Terms.

About Our Services

The ChatterBudz ecosystem includes:

• ChatterBudz Chat: A privacy-first messaging application for users 13 years and older
• ChatterBudz Pay: A payment management application for tracking bills, subscriptions, and payments
• ChatterBudz Play: A curated media library application with parental controls for family use

1. Eligibility

ChatterBudz Chat: You must be at least 13 years old to use this application. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or legal guardian.

ChatterBudz Pay: You must be at least 13 years old to use this application. Users under the age of majority should use this app with parental supervision.

ChatterBudz Play: The account holder (parent/admin) must be at least 18 years old. This app is designed for family use, and parents are responsible for managing their children's access and content. Children may use the app under parent-managed profiles.

2. Accounts

When creating an account, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

For ChatterBudz Play, parent/admin account holders are responsible for all activity under their account, including activity by child profiles they create and manage.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful or harmful purposes
• Harass, abuse, threaten, or harm other users
• Attempt to interfere with or disrupt the integrity, security, or performance of the Services
• Share content that is illegal, harmful, or violates others' rights
• Impersonate others or provide false information
• Attempt to gain unauthorized access to accounts or systems

App-Specific Use:

• Chat: Do not use Chat to send spam, threats, or inappropriate content
• Pay: The app is for tracking and managing payments; we do not process actual payments
• Play: Parents are responsible for ensuring content added is appropriate and legally obtained

4. Content and User-Generated Content

ChatterBudz Chat: You retain ownership of messages and content you share. You grant us a limited license to host, store, and transmit that content as necessary to operate the Services. We may remove content that violates these Terms or applicable law.

ChatterBudz Pay: You own the payment information you enter. We store this data solely to provide the payment management features. We do not process payments or interact with financial institutions on your behalf.

ChatterBudz Play: You are responsible for the media content you add to your library. You must have the right to access and share any content you add. Parents are responsible for ensuring content is appropriate and legally obtained. We do not monitor, filter, or curate user-added content beyond technical availability.

5. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or use the Services in a manner that could cause harm.

6. Disclaimer & Limitation of Liability

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties. Our liability is limited to the maximum extent permitted by applicable law.

7. Changes to These Terms

We may update these Terms from time to time. The date above indicates the latest revision. Continued use of the Services after changes means you accept the revised Terms.

8. Governing Law

These Terms shall be governed by and construed under the laws of Australia, without regard to its conflict of law rules.

9. App-Specific Terms

ChatterBudz Chat

Chat is a messaging service. We do not guarantee message delivery times or availability. Features may vary by platform. Friend connections require mutual consent. We reserve the right to moderate content that violates these Terms.

ChatterBudz Pay

Pay is a payment tracking and management tool. We do not process payments, store payment card information, or interact with banks or payment processors. You are solely responsible for making actual payments to billers. The app helps you track and remember payments but does not execute transactions.

ChatterBudz Play

Play is a media library management tool. We do not host or provide media content. You are responsible for ensuring you have the right to access and share any media URLs you add. Parents are responsible for content curation and their children's use of the app. We are not responsible for the content or availability of third-party media sources (e.g., YouTube).
